What happens if the company director changes during construction?

Share

When a company director or secretary (be they owner, builder, designer, or assigned certifier) changes during construction, i.e. after signing the initial statutory assignments/undertakings or design certificates, this is not considered a change in owner, designer or builder (i.e. it remains the same company but with different directors).

However, for the purpose of completing the Certificate of Compliance on Completion (CCC), the CCC must be signed by an existing company secretary or director; this change of protocol should be initiated to ensure that a current company member undertakes the process.

On the other hand, if a company is dissolved and the same directors and chairman intend to complete the building project, this is considered a different entity and a change of owner/builder may be required.
